By accessing or using the Custom Wallpaper application ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service. These Terms apply to all users worldwide, including users in the United States, the European Union, Japan, South Korea, and other jurisdictions.
The Service allows users to upload, crop, and submit digital wallpaper images for display on connected devices. The Service processes images through automated moderation, resizing, and optional GIF-to-AVI conversion before delivering them to the target device.
You must be at least 16 years old (or the age of digital consent in your country of residence, whichever is higher) to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service. Users in South Korea must be at least 14 years old. Users in Japan must be at least 16 years old.
The Service uses a token-based device connection system. Tokens are used solely to authenticate and associate uploaded content with your device. You are responsible for maintaining the confidentiality of any tokens associated with your device. You agree to notify us immediately if you suspect unauthorized use of your token. Tokens may be revoked at any time for security reasons.
You retain all ownership rights to the images you upload. By uploading an image, you grant us a non-exclusive, worldwide, royalty-free license to process, store, resize, convert, and transmit your image solely for the purpose of providing the Service to you. This license terminates when you delete your image or your account, subject to technical limitations and applicable law.
You represent and warrant that: (a) you own the images you upload or have the necessary rights to use them; (b) your images do not infringe any third-party copyright, trademark, privacy, or other intellectual property rights; and (c) your images comply with all applicable laws and these Terms.
You may not upload images that contain or depict:
We use automated image moderation technology (Amazon Rekognition) to screen uploaded content. We reserve the right to reject or remove any content that violates these Terms, in our sole discretion.
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy, including the processing of your images through automated moderation systems and storage on cloud infrastructure.
The Service, including its design, layout, code, and branding, is owned by us and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse-engineer any part of the Service without our prior written consent.
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. For users in the European Union, nothing in these Terms limits your statutory rights as a consumer. For users in Japan, nothing limits our liability for damages arising from our intentional misconduct or gross negligence. For users in South Korea, nothing limits our liability under the Act on the Consumer Protection in Electronic Commerce.
We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or us. Upon termination, your right to use the Service immediately ceases. Images associated with your token may be deleted from our servers.
These Terms shall be governed by the laws of Japan, without regard to its conflict of law provisions. For users in the European Union, you may also bring proceedings in your country of residence. For users in South Korea, Korean law shall apply to the extent it provides greater consumer protection.
We encourage you to contact us first to resolve any dispute informally. If we cannot resolve a dispute, you agree to submit to the exclusive jurisdiction of the courts of Japan. EU users may also bring claims in their local courts. South Korean users may also bring claims in Korean courts.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the changes, you should stop using the Service.
